No, it checks if it can create an IPv6 socket, and that is then assumed to mean that it works.

Are you saying that your stack is "disabled" but you can still create IPv6 sockets? Then exactly in which way is it disabled?

And if you think libcurl should detect your case as disabled-ipv6, how do you propose it should do to detect this? I lean very strongly toward my initial reaction: this is your (kernel) config and your libc, I don't see how libcurl does wrong here.

Observation:
IPv6 DNS requests were sent out from Android Handsets even if the IPv6 stack is not present on the device.
Expected Result:
If there is no IPv6 stack on the device/machine, the IPv6 request should not be sent from the device.
Workaround:
Using option "CURL_IPRESOLVE_V4", disables sending IPv6 DNS queries.
